Laws against Unsolicited Texts, Faxes and Cellular Phone Calls
Text Messages:
The Telephone Consumer Privacy Act (TCPA) at 47 U.S.C. 227 et seq, regulates consumer solicitations made via telephone, fax and text messaging. The TCPA prohibits unsolicited text messages to cell phones unless the message is sent for emergency purposes or recipients give their written consent to receive such messages (See Satterfield v. Simon & Shuster 569 F.3d 946).
Misleading Caller I.D.s:
In addition, some companies use misleading phone numbers or company names to disguise their true identity from a recipient’s caller ID in order to fool them into answering the telephone. This is not allowed pursuant to California Public Utility Code §2893(a) and 47 U.S.C. §227 or 15 U.S.C. §1692(d).
