Unsolicited Junk Faxes
If you received an unsolicited fax advertising property, goods or services, and
You did not give the faxing party previous permission, and
The faxing party was not a charity or non-profit OR
The fax you received does not contain:
a. The name of the sender, and
b. The sender’s fax number, and
c. The date and time that the fax was sent, you could be entitled to civil penalties
of up to $500.
One may always choose to bring their own small claims action against a party sending unsolicited faxes, in an attempt to be awarded $500. This however, is not enough of a financial deterrent to the violating party to cause them to stop this annoying practice.
On the other hand, if the company is doing this as a general business practice, not just to you but thousands of consumers, an effective and powerful approach may be the use of a class action in which they would be have legal exposure for all the unlawful faxes that they had sent. This type of litigation often changes business practices and you could be the class representative that made it happen.
